YK Law

Email Disclaimer

This page sets out the terms that apply to emails sent by YK Law, including any attachments. It is linked from the signature block of our emails. Each section below contains the formal terms, a short plain-English explanation, and the main laws that apply.

1. Confidentiality and privilege

This email, including any attachments, is intended only for the named recipient(s). It is confidential and may be subject to legal professional privilege. Neither confidentiality nor privilege is waived or lost because this email has been sent to you by mistake.

If you are not the intended recipient, you must not read, use, copy, disclose or distribute this email or any information in it. Please notify us immediately by return email or by telephone on +61 2 9249 9162, and then delete it and destroy any copies.

What this means

Our emails often contain private information about our clients and their legal affairs. If you have received one of our emails by mistake, please do not read it, share it or act on it. Let us know straight away, then delete it. Receiving it in error does not make the information public, and our client's legal protections over it continue to apply.

Unless you are an existing client of YK Law and this email relates to your matter, its content is general information only and is not legal advice. You should not act, or refrain from acting, in reliance on it without first obtaining specific legal advice about your circumstances.

A solicitor–client relationship with YK Law arises only under a written costs agreement or engagement letter.

What this means

Unless we are already acting for you on the matter the email is about, please do not treat it as advice about your situation. We only become your lawyers once we have agreed in writing to act for you, which normally includes telling you in writing how our fees will be worked out.

3. Cyber fraud and payment instructions

YK Law will never notify you of a change to our bank account details by email. Before transferring any money to us, you must verify our account details by telephoning a member of YK Law known to you, using a telephone number you have obtained independently. Do not use any telephone number, link or account details contained in an email that appears suspicious or that asks you to pay to new or changed account details.

YK Law accepts no responsibility for any loss you suffer as a result of paying money into an incorrect account.

Protect yourself in three steps

  1. Stop. Do not act on any email, text or call that asks you to pay to new or changed bank details, however genuine it looks.
  2. Check. Call a YK Law team member you know on a phone number you have verified independently, such as from our website or an earlier letter, and confirm the details before you pay.
  3. Report. If something seems wrong, tell us on +61 2 9249 9162 and contact your bank immediately.

Where to report scams and cybercrime

What this means

Criminals sometimes hack or imitate law firm emails to trick people into sending money to the wrong bank account. We will never change our bank details by email. Always phone us on a number you already know and trust to confirm account details before you send any money. If you pay into the wrong account because you did not check with us first, we will not be responsible for that loss.

4. Viruses and email integrity

YK Law takes reasonable steps to ensure that its emails and attachments are free from viruses and other harmful code, but we do not guarantee that they are. You are responsible for scanning this email and any attachments before opening them.

Email may be intercepted, corrupted, delayed or altered in transmission. To the extent permitted by law, YK Law accepts no liability for any loss or damage arising from viruses or harmful code, or from the interception, corruption or unauthorised alteration of this email or any attachment after it was sent.

What this means

We work to keep our emails safe, but no email system is perfect. Please use up-to-date security software and check attachments before opening them. Emails can be tampered with after they leave us. If a document you received from us looks different from what you expected, please check with us before relying on it.

5. Privacy

YK Law handles personal information in accordance with the Privacy Act 1988 (Cth), including the Australian Privacy Principles, and our Privacy Policy, available at https://yingke.com.au/privacy.

What this means

We only collect, use and share personal information in line with Australian privacy law and our Privacy Policy. You can ask to see the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Our Privacy Policy explains how to make a request or a complaint. If you are not satisfied with our response to a complaint, you can contact the Office of the Australian Information Commissioner.

6. Professional standards

Liability limited by a scheme approved under Professional Standards Legislation.

What this means

YK Law participates in a professional standards scheme that has been approved by government. Under the scheme, the amount of damages the firm may have to pay if a claim is made against it may be capped. In return, the firm must hold professional indemnity insurance and meet professional standards set under the scheme, which helps protect clients.
